General terms and conditions of use
1. Identification of the parties
The present Terms and Conditions of Use, registers one party as being flowgy, and the other party the user, individual or entity that accesses the website freely and voluntarily.
2. Obligations of the users
By merely accessing and visiting the website, the user agrees to:
a. Use the website in a diligent, correct and licit way, always respecting current legislation, moral and decency, as well as public order.
b. Regularly revise these conditions or any other that can be applied, verifying any modifications that may have occurred.
c. Revise the communications sent by flowgy, as they may contain important information.
d. Not use the website for commercial purposes, especially to collect information or other content, with the aim of offering services that constitute as clear competitors of flowgy.

3. Intellectual and industrial property rights
All intellectual and industrial rights of the website and its contents, in which the following are included: programming, design, applications, graphics, codes, text or images, brands, commercial names, distinctive signs and other elements present, are exclusively owned by the owner, or count on rights and/or sufficient authorisation for its use.

flowgy constantly works so that the services and functions of the Website are always available. Nevertheless, when you access the site, the availability will be shown together with its limitations at any given moment in time.
Despite the continuous efforts of the owner to protect the systems and content included on the website, using the regular security standards commonly used on the internet, it is not possible to offer total guarantees regarding intrusions or loss of information that could occur. Likewise, fflowgy cannot guarantee the absence of viruses or other damaging elements on the website or other sites, which could produce alterations to the computer system or device of the user, in both hardware and/or software. Consequently, the user accepts and understands that there are certain circumstances that are outside flowgy´s control.
The website can include links to pages or websites of third parties, to which flowgy accepts no liability as they neither approve nor revise their content or function. The user who accesses any of the published links on the website, does so at their own risk, flowgy will accept no liability for any such actions.
Furthermore, the website is exempt from any liability for the incorrect use of the site by the user, as well as any possible breach of their obligations and agreements taken on in virtue of these terms and conditions or any that may be applied.
5. Infractions
The owner can sanction any of the users that do not comply with the conditions that are applied, with the temporary or indefinite exclusion from accessing the website. The duration of the sanction depends on the severity of the infraction committed. Access restriction does not imply compensation in any case.
6. Compensation
Any type of damages, prejudice, loss or cost (including solicitor’s fees and/or barristers) caused by a breach by the user of these conditions or any other applicable, incurred upon flowgy, the latter must be reimbursed by the user responsible for the breach. This includes any claims by third parties affected by said breach.
7. Modifications
The present Terms and Conditions can be modified and/or updated at any moment without prior notice. Any modifications made will come into effect from the moment it is made public on the website, regardless of the media or method used to execute it.
The modifications will only affect the users who had accepted them subsequent to said modifications.
8. Other questions
8.1. Safeguard and interpretation
If the competent authority declares any of these provisions as illegal, invalid or unfeasible, an interpretation would need to be made with the closest proximity to the original intention of the provision. Nevertheless, any declaration made regarding any of the clauses stated, will not be detrimental to the validity of the remaining.
Not demanding the strict compliance of any of the terms and conditions made by the owner at a given time, cannot be interpreted in any way as a relinquishment of all rights to demand compliance in the future.

The language applicable to these terms and conditions is Spanish, and any other version of said policy, in a language other than Spanish, is merely for the comfort of the user. However, the Spanish version of the Terms and Conditions will always be the legitimate version in effect, and the user agrees to that presented in the Spanish version.
8.3. Legislation y Jurisdiction
Any relationship between the owner and the user will be governed by Spanish legislation. In the case of any dispute over the compliance or interpretation of the General Terms and Conditions, the user agrees to renounce any other jurisdiction that could correspond to them, and, unless it is legally imperative an alternative jurisdiction, the dispute will be heard at the courthouse or magistrates court in Murcia.
