flowgy (hereinafter, flowgy or the owner, used interchangeably), whose address is CEDIT UPCT Technological Park of Fuente Álamo. Calle 5 P.P. los Leones, 51, 30332 Fuente Álamo, Murcia, is owner of the Website which can be accessed via the URL: https://www.flowgy.com/  (hereinafter, el Website). The present text contains the conditions that, by general means, regulate the use of and access to the Website.

1. Identification of the parties
‍The present Terms and Conditions of Use, registers one party as being flowgy, and the other party the user, individual or entity that accesses the website freely and voluntarily.

‍2. Obligations of the users
‍By merely accessing and visiting the website, the user agrees to:

a. Use the website in a diligent, correct and licit way, always respecting current legislation, moral and decency, as well as public order.

b. Regularly revise these conditions or any other that can be applied, verifying any modifications that may have occurred.

c. Revise the communications sent by flowgy, as they may contain important information.

d. Not use the website for commercial purposes, especially to collect information or other content, with the aim of offering services that constitute as clear competitors of flowgy.

e. Not modify or try to modify anything, nor to perform any action or use any means aimed at simulating the appearance or features of the website.

f. Not damage, disable, overload, or hinder the service (or the network or networks connected to the service), or interfere with its use and enjoyment.

g. Refrain from performing any action that would lead to the introduction of any virus, worm, Trojan, or any other class of malicious code designed to interrupt, destroy or limit the correct working order of the website.

h. Not use reverse engineering techniques and/or decipher, decompile, or use any other component designed to know the source code of the website.

i. Not to perform any act that could violate the rights or interests of the owner or third parties that could be, for example, intellectual or industrial property (patents, brands, copyright rights, commercial secrets…).

‍3. Intellectual and industrial property rights
‍All intellectual and industrial rights of the website and its contents, in which the following are included: programming, design, applications, graphics, codes, text or images, brands, commercial names, distinctive signs and other elements present, are exclusively owned by the owner, or count on rights and/or sufficient authorisation for its use.

As a consequence of the above, any reproduction, distribution, public communication (including making it available), transformation or any other use, not even citing sources, are totally forbidden, unless previous consent has been expressly given and in writing by the owner or the exclusive owner of the rights which are affected. If you detect any infraction, we urge you to communicate the issue by e-mail, indicating the infraction in the e-mail header.

‍flowgy constantly works so that the services and functions of the Website are always available. Nevertheless, when you access the site, the availability will be shown together with its limitations at any given moment in time.

Despite the continuous efforts of the owner to protect the systems and content included on the website, using the regular security standards commonly used on the internet, it is not possible to offer total guarantees regarding intrusions or loss of information that could occur. Likewise, fflowgy cannot guarantee the absence of viruses or other damaging elements on the website or other sites, which could produce alterations to the computer system or device of the user, in both hardware and/or software. Consequently, the user accepts and understands that there are certain circumstances that are outside flowgy´s control.

The website can include links to pages or websites of third parties, to which flowgy accepts no liability as they neither approve nor revise their content or function. The user who accesses any of the published links on the website, does so at their own risk, flowgy will accept no liability for any such actions.

Furthermore, the website is exempt from any liability for the incorrect use of the site by the user, as well as any possible breach of their obligations and agreements taken on in virtue of these terms and conditions or any that may be applied.

‍5. Infractions
‍The owner can sanction any of the users that do not comply with the conditions that are applied, with the temporary or indefinite exclusion from accessing the website. The duration of the sanction depends on the severity of the infraction committed. Access restriction does not imply compensation in any case.

‍6. Compensation
‍Any type of damages, prejudice, loss or cost (including solicitor’s fees and/or barristers) caused by a breach by the user of these conditions or any other applicable, incurred upon flowgy, the latter must be reimbursed by the user responsible for the breach. This includes any claims by third parties affected by said breach.

‍7. Modifications
‍The present Terms and Conditions can be modified and/or updated at any moment without prior notice. Any modifications made will come into effect from the moment it is made public on the website, regardless of the media or method used to execute it.

The modifications will only affect the users who had accepted them subsequent to said modifications.

‍8. Other questions
8.1. Safeguard and interpretation
‍If the competent authority declares any of these provisions as illegal, invalid or unfeasible, an interpretation would need to be made with the closest proximity to the original intention of the provision. Nevertheless, any declaration made regarding any of the clauses stated, will not be detrimental to the validity of the remaining.

Not demanding the strict compliance of any of the terms and conditions made by the owner at a given time, cannot be interpreted in any way as a relinquishment of all rights to demand compliance in the future.

8.2. Language
‍The language applicable to these terms and conditions is Spanish, and any other version of said policy, in a language other than Spanish, is merely for the comfort of the user. However, the Spanish version of the Terms and Conditions will always be the legitimate version in effect, and the user agrees to that presented in the Spanish version.

8.3. Legislation y Jurisdiction
‍Any relationship between the owner and the user will be governed by Spanish legislation. In the case of any dispute over the compliance or interpretation of the General Terms and Conditions, the user agrees to renounce any other jurisdiction that could correspond to them, and, unless it is legally imperative an alternative jurisdiction, the dispute will be heard at the courthouse or magistrates court in Murcia.

The present Privacy Policy regulates the collection and use of the personal data provided by the user when they access and make use of the service available on the website found at the following URL: https://www.flowgy.com (hereinafter, the website).

Whenever the use or request of any service, where the disclosure of personal information is necessary, the users will guarantee its veracity, accuracy, authenticity, and validity.  It is therefore the responsibility of the user to maintain up to date such information, in order to remain accurate at all times.

flowgy, as owners of the website, will use the information for the purposes stipulated below.

a. Contact: The user can contact flowgy, following the indications given in the section “Contact” on the website, to make requests, suggestions, complaints or any other generic communication.  The data provided by the user will be used by the owner to respond to the requests and/or communications, and to get in contact with the user. The legitimacy base of this use is sustained by the consent given by the user. The information will be retained for 12 months, unless an alternative period has been stated

b. Get a Demo: The user can request that flowgy supplies them with specific information regarding their services, via the section designed for that purpose on the website. The identifying data and the contact details provided will be used by the owner to deal with the user’s requests, make contact with them, and offer them the requested information. The legitimacy base of this use is sustained by the consent given by the user. The information will be retained for 12 months, unless an alternative period has been stated.

a. Publicity related to the contracted services: When the user requests the services of flowgy, the latter can send commercial material related to the services contractually agreed. The legitimacy base of this use is sustained by the legitimate interest of the owner. The information will be retained for a duration of five years, unless the user opposes such action before the due expiration date, or if an alternative duration time has been applied.

b. Publicity by flowgy: Only in the case of explicit consent by the user, the information provided will be used by flowgy to send commercial communication via electronic media about our services. The legitimacy base of this use is sustained by the consent given by the user. The information will be retained for 12 months, unless an alternative period has been stated.

c. Cookies: The website uses technology to implant files known as cookies onto the computer or device that is being used to access and visit the website.  The cookies can be blocked or deactivated at any moment using the options on the browser settings.  If you would like more information please consult our Cookie Policy. The legal base for the use of such information is sustained by the consent of the user. The period of which the information will be retained depends on the cookie in question.  The duration varies, or until the user eliminates the cookie from their computer or device.

The user can revoke consent for the use of their information, exercising their right to the access, modification, suppression, portability, opposition and limitation of its use, by informing flowgy via E-mail at welcome@flowgy.com, or in writing to the address mentioned above, and indicating the reference “Data Protection”. In both cases, the communication sent should be accompanied by official documentation which permits the correct identification, and thus avoiding access to your data by any other third parties.  Finally, the user can communicate any modification in writing, or request its removal from the database, by indicating so, to any of the given addresses. At any moment the user can make a claim to the Control Authority.

Modification of the Privacy Policy: flowgy reserves the right to modify its privacy policy at any time, respecting current legislation in data protection material and with previous communication to the interested parties.

Language applicable to the present Privacy Policy: The language applicable to this Privacy Policy is Spanish, and any other version of said policy in a language other than Spanish is merely for the comfort of the user and to facilitate its understanding.  However, the Spanish version of the Privacy Policy will always be the legitimate version in effect.

Therefore, if any contradiction of terms between the Privacy Policy of any language and its original Spanish version, the latter will always prevail.
